Terms of Service

Welcome to Gamesrv. By creating an account or using our services, you agree to these Terms of Service (“Terms”). Please read them carefully.

1. Service description

Gamesrv provides on-demand game server hosting for supported titles, billed monthly. We run your servers on bare-metal hardware we operate ourselves. We do not resell third-party cloud infrastructure.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Gamesrv. By registering, you confirm that the information you provide is accurate and that you have the right to enter into this agreement.

3. Account and security

• You are responsible for all activity under your account.
• You must keep your credentials confidential and notify us of any unauthorized access.
• We may suspend or terminate accounts that violate these Terms or that are used in ways that harm the service or other users.

4. Billing

• Each game server is a separate subscription billed monthly via Stripe.
• Prices are displayed in USD or EUR. A Stripe customer can only hold subscriptions in a single currency.
• You may cancel any server at any time. Billing stops immediately and your server is shut down. No partial refunds are issued for the remaining portion of the current billing period.
• Failed payments may result in server suspension. We will retry payment per Stripe's dunning rules before suspending.

5. Acceptable use

You agree not to use Gamesrv to:

• Host content that is illegal, infringing, harmful, harassing, or that violates the rights of others.
• Run unauthorized software, cryptocurrency mining, DDoS tools, or attempt to compromise our infrastructure.
• Circumvent resource limits, tamper with other users' servers, or probe network boundaries.
• Host any game server in violation of the underlying game's end-user license agreement.

Violations may result in immediate suspension and termination without refund.

6. Game content and mods

You are responsible for any mods, plugins, or game content you install on your servers. Mods are downloaded from third-party sources (Modrinth, Thunderstore, Factorio Mod Portal, uMod, GitHub) at your direction. We do not warrant third-party content and are not liable for damages arising from its use.

7. Data and backups

Your game worlds and configuration files are stored on our infrastructure. While we take reasonable care (redundant disks, periodic snapshots), you are responsible for maintaining your own backups of data you consider critical. Server deletion is permanent and irreversible.

8. Availability and support

We target 99.9% monthly uptime but do not guarantee it contractually. Support is provided on a best-effort basis via the contact address below. Planned maintenance windows will be announced when feasible.

9. Limitation of liability

To the maximum extent permitted by law, Gamesrv is provided “as is” without warranties of any kind. Our aggregate liability for any claim arising out of or relating to the service is limited to the fees you paid us in the twelve months preceding the event.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or dashboard notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of France. Any dispute will be resolved by the competent courts of Paris, France, except where mandatory consumer protection law grants you the right to bring a claim in your own jurisdiction.
